Is Massachusetts a 50/50 Divorce State?

Updated: Jun 15, 2018

Massachusetts is not a 50/50 state for divorce. Massachusetts is an equitable division state. In other words, the Massachusetts Probate and Family Court judge will determine what is "fair" when dividing assets and debts and will consider multiple factors in order to make that determination. Your division of assets and debts may or may not end up being 50/50. The judge has a great deal of discretion and that decision is very often different from judge to judge.
